Preliminary remarks
Participation in the marketing campaign of mfi Immobilien Marketing GmbH (Klaus-Bungert-Str. 1, 40468 Düsseldorf), hereinafter referred to as the organizer, is free of charge and does not constitute any obligation to purchase. Participation is governed exclusively by these GTCP or any additional special conditions of participation that may apply.
§ 1 Procedure
The duration of the marketing campaign depends on the announced participation period. Within this period, participants will have the opportunity to take part in the marketing campaign. If the marketing campaign takes place simultaneously on several platforms (in particular social media platforms such as Facebook and Instagram), it is possible to participate once per platform.
§ 2 Participation
In order to participate in the marketing campaign, it is necessary to register on the marketing portal or social media platform and to answer or fulfil the question or task, unless mere registration is sufficient for participation.
Participation is only possible within the announced participation period. Entries / submissions received after the closing date will not be considered for the allocation of prizes.
§ 3 Eligible
3.1 Eligible participants are natural persons who are resident in Germany and of legal age (see § 2 BGB). Minors and persons of limited legal capacity are entitled to participate if their legal representative has consented to their participation. Each participant may only participate in their own name and only once per competition, unless expressly stated otherwise.
3.2 Excluded from participation are employees of the Organiser and companies affiliated with the Organiser pursuant to Sections 15 et seq. AktG (German Stock Corporation Act) as well as employees of the companies commissioned to carry out the marketing campaign and relatives of employees of the aforementioned companies. In addition, the Organiser reserves the right to exclude persons from participation at its own discretion if there are justified reasons, in particular in the event of manipulation in connection with access to or implementation of the marketing campaign, in the event of violations of these conditions of participation,
in the event of unfair conduct or in the event of false or misleading information in connection with participation in the marketing campaign.
§ 4 Prize, notification and transfer of the prize
4.1 The named prizes will be awarded. The organiser reserves the right to replace the named prizes in whole or in part with other prizes at any time at short notice without giving reasons.
4.2 The winners will be determined and the prizes distributed by means of a random draw among all participants, unless expressly determined otherwise. If the marketing campaign is linked to a task - e.g. answering a competition question or participating in a survey - only those participants who have solved the task correctly will be entered into the prize draw.
4.3 The winners of the marketing campaign will be informed promptly by email, direct message or comment about the prize. In the event of a win, the organiser will ask the winners to provide personal details (first name, surname and address), which the winners must submit to the organiser within 7 days of notification. The submission of this personal data will be used to transfer the prize. Participants warrant that the personal details they provide, in particular their first name, surname and address, are true and correct. Failure to provide or incorrect provision of this data will result in forfeiture of the right to the prize. In this case, the organiser is entitled to select a winner subject to the further requirements of these conditions of participation.
4.4 Unless otherwise specified, the prize must be collected from the organising shopping centre, which is managed by the Organiser, upon presentation of an identification document to verify identity. The prize cannot be exchanged or paid out in cash unless the prize is explicitly a cash amount. The prize is non-transferable. The winner must confirm this in writing when collecting the prize.
4.5 Any additional costs associated with claiming the prize shall be borne by the winners. The winners themselves are responsible for any taxation of the prize.
§ 5 Termination of the competition
The organiser expressly reserves the right to terminate the marketing campaign without prior notice and without giving reasons or to amend the conditions of participation (with the exception of the regulations on data protection). This applies in particular to any reasons that would disrupt or prevent the marketing campaign from running as planned.
§ 6 Data protection
6.1 mfi Immobilien Marketing GmbH as the organiser is responsible for the processing of personal data. The contact details are:

6.2 When participating in the marketing campaign, the following personal data will be processed electronically for the purpose of organising and running the competition: First name and surname, title and address if applicable, as well as e-mail.
6.3 The legal basis for data processing is the fulfilment of a contract (competition) within the meaning of Art. 6 para. 1 lit. b) GDPR.
6.4 The personal data will be stored until the marketing campaign has been fully completed and deleted within two months of completion.
6.5 The organiser expressly points out that the personal data will not be passed on to third parties without consent. With regard to the data collected and processed by social media platforms in the context of platform use, the Organiser refers to the privacy policy of the respective social media platform.
6.6 If the Organiser uses external service providers to carry out the marketing campaign, these service providers are obliged to maintain data confidentiality and are bound by German data protection law on the basis of special contractual provisions (contracts for commissioned data processing).

6.7 The Organiser draws attention to the rights of data subjects under Art. 15-18 and Art. 20 GDPR.
6.8 In the event of a win, the winner agrees to the publication of his/her name in the advertising media used by the Organiser. This includes the announcement of the winner on the organiser's website and its social media accounts (possibly using a photo/video). We would like to point out that you as a participant can object to the publication of your data at any time for the future. The revocation must be sent in writing to the above-mentioned responsible body / organiser of the marketing campaign. Once consent has been withdrawn, the participant's personal data collected and stored will be deleted immediately.
§ 7 Liability
Any liability for damages on the part of the organiser, including its employees and vicarious agents, arising from or in connection with the marketing campaign, regardless of the legal grounds, shall be limited to cases of intent or gross negligence. Damages due to injury to life, body and health or under the Product Liability Act are excluded from the limitation of liability.
Participants are solely responsible for ensuring that their participation documents are lawful and do not infringe any third-party rights.
§ 8 Declaration of exemption
The organiser organises the marketing campaign itself. It is in no way connected to a social media platform and is in no way sponsored, supported or organised by such a platform.
§ 9 Applicable law
The organiser's marketing campaign is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.
